Deprivation of British Nationality
Legal Basis
- The UK government can remove British citizenship under:
- Section 40 of the British Nationality Act 1981 (as amended)
- Nationality and Borders Act 2022 provisions
Grounds for Deprivation
- The Home Secretary may strip citizenship if:
1. Conduct Grounds
- Obtained citizenship by fraud/false representation
- Engaged in extremism or terrorism-related activities
- Demonstrated serious disloyalty to the UK
2. Public Good Grounds
- Deprivation is conducive to the public good
- Individual has dual nationality (to avoid statelessness)
Key Legal Tests
- The Home Office must prove:
- Decision is proportionate
- Individual would not be made stateless (with limited exceptions)
- Conduct is seriously prejudicial to vital UK interests
Appeal Process
- First-tier Tribunal (Immigration Chamber) appeal within 28 days
- Potential SIAC (Special Immigration Appeals Commission) cases involving national security
- Judicial Review option in higher courts

- Nationality and Borders Act 2022 expanded deprivation powers
- No-notice deprivations permitted in certain cases
- Lower threshold for terrorism-related cases
