Group 2 refugees, granted temporary permission to stay after 28 June 2022, face restrictions on family reunion rights. They are only eligible for family reunion if refusing would breach the UK’s international obligations. Case law is evolving, and decision-makers must assess whether refusing family reunion would violate the right to family and private life and whether there are insurmountable obstacles to family unity elsewhere.
To prove a relationship, applicants can provide:
DNA testing is not mandatory but is recommended to support the claim. The decision-maker cannot draw negative inferences from the absence of DNA evidence.
Children cannot sponsor their parents under the refugee family reunion rules. However, decision-makers may use discretion to consider compelling, compassionate factors and grant leave outside the rules on a case-by-case basis.
Individuals granted refugee family reunion will not receive travel documents and must keep their own national passport.
