Costs:
There is no fee for refugee or humanitarian protection status holders applying for settlement. This also applies to the partner’s child.
Application Process:
- Form: Applications must be made online using the specified forms, SET (Protection Route) or SET (P).
- Biometrics: Provide biometric information.
- Identity Proof: Submit Biometric Residence Permit (BRP) or travel documents.
- Location: Applicants must be in the UK on the application date and cannot travel until further leave is granted.
Suitability Requirements:
A caseworker will check for any criminal convictions. Any conviction, including non-custodial sentences, may result in mandatory refusal unless a specified period has passed. Serious convictions could lead to revocation of refugee status under paragraphs 339ae or 339ac of the rules.
Earliest Application Date:
Applications can be made up to 28 days before the initial leave expires. Though late applications are accepted, applying before expiry helps maintain your right to work and access public funds while your application is being processed, which can take up to six months.
Safe Return Review:
The Home Office conducts a safe return review to determine if continued protection is appropriate. Circumstances that may lead to refusal include:
- Reapplying for a National Passport: This might be seen as reavailment of the country of origin's protection.
- Return to Country of Origin: Returning may indicate no longer facing persecution.
- Significant Changes in Country of Origin: Consideration of changes in the country’s conditions.
- Changes in Personal Circumstances: Personal changes might affect the risk assessment.
- Evidence of Misrepresentation: Any false information provided in the original refugee claim.
