Additional Requirement for Applications Post-April 6, 2019:
Applicants must show not only that they are stateless and not admissible to any country but also that they have made every effort to acquire a nationality or a right to admissibility in another country. For children born in the UK, evidence should be provided that attempts to register the birth with relevant authorities were refused.
UK Immigration Rules (April 2013 Amendments):
The amendments include provisions for stateless persons, defining a stateless person as someone not considered a national by any state. To succeed in an application, the applicant must:
- Make a valid application for limited leave to remain as a stateless person.
- Be recognized as stateless by the Secretary of State per paragraph 401.
- Not be admissible to their former habitual residence or any other country.
- Submit all reasonably available evidence to determine their stateless status.
Administrative Review vs. Appeal:
Stateless applications do not attract a right of appeal but do allow for administrative review. It is crucial to raise a human rights claim to attract the right of appeal.
